When can I apply and until when?

Who is it aimed at?

The measure is intended for foreign nationals who were already living in Spain before January 1, 2026, and who are currently in an irregular administrative situation. General requirements for all applicants

Regardless of whether you applied for asylum or not, there is a common set of requirements that anyone wishing to take advantage of this regularization must meet:

  • To have arrived in Spain before January 1, 2026.
  • Prove a continuous stay of 5 months, without departures, prior to the date of submission of the application. Bmurilloabogada
  • No criminal or police record in Spain.

  • Not to pose a threat to public order.
  • Not to have any other residence or stay permit in force on the date of application.

The three paths to regularization: choose the one that corresponds to you.

If you did not apply for international protection, you must meet the general requirements. and also prove at least one of these three assumptions:

1. Employment route

Having worked (employed or self-employed) during your stay in Spain, or proving your intention to work by providing a job offer of more than 90 days in a year, or a declaration of responsibility to work as a self-employed person.

2. Family route

Stay in Spain with your family unit: minor children, adult children with dependency due to disability or health, or first-degree ascendants who live with you.

3. Pathway of vulnerability

If you applied for asylum before January 1, 2026

There is a separate, specific pathway for applicants for international protection. The requirements are: being of legal age and having remained in the country without leaving for the 5 months prior to submitting the application, having submitted an asylum application before 01/01/2026, having no criminal or police record in Spain or in the countries of residence in the last 5 years, not posing a threat to public order, and not being prohibited from entering Spain. What documents do you need?

The key is to prove you've been in Spain for a while. Public documents, such as your registration certificate or medical records, can be accepted, as well as private documents like rental agreements, receipts, or tickets with your name and date. If you already submitted your foreign criminal record certificate in a previous procedure with the Spanish authorities, you don't need to request it again. And if you've been waiting for the certificate for more than a month and it hasn't arrived, you can submit proof of having requested it along with a sworn statement.


Where and how to submit the application?
